3M Defective Earplug Lawsuits

Compassionate, Experienced Injury Attorneys Since 1989

The United States Department of Justice has recently reported that a long-time defense contractor, 3M paid more than $9 million to settle a lawsuit regarding the Dual-Ended Combat Arms™ Earplugs, Version 2 (CAEv2) it sold to the military. The CAEv2 earplugs were standard issue for troops deployed to Iraq and Afghanistan between 2003 and 2015 and are believed to have contributed to service members’ deteriorated hearing.

A whistleblower lawsuit revealed that the earplugs failed safety testing in 2000 and that 3M was aware of the design defect and its potential to harm users but continued to sell CAEv2s to the U.S. military. As a result, many service members have experienced severe hearing loss.

About 3M Earplug Injuries

Active duty military personnel may have used 3M CAEv2 earplugs to block out damaging sound created by explosions and gunfire while in the field. The unique design was intended to block out potentially dangerous noise while still allowing non-damaging sound through, enabling military members to communicate while on duty. Unfortunately, due to a design flaw that 3M was allegedly aware of, the resulting product was faulty. In the event of an explosion or heavy gunfire, a military member wearing the defective earplugs might sustain serious, long-lasting, or permanent hearing damage.

The defective 3M earplugs can cause the following:

  • Partial hearing loss
  • Complete hearing loss
  • Tinnitus (ringing in the ears)

Do You Have a Case?

If you have used the CAEv2 earplugs during deployment in Afghanistan or Iraq between 2003 and 2015 (or in any other capacity during this time period), we urge you to have your hearing assessed and seek legal representation immediately regarding any auditory damage you may have.
