About Dram Shop Laws
Depending on where you live, dram shop laws may or may not be applicable in a drunk driving case. In North Carolina, for example, the General Statutes §18B-121 allows an injured person to hold an alcohol vendor accountable if:
- The vendor sells or serves alcohol to a minor under the age of 21;
- The minor causes a car accident while under the influence of that alcohol; and
- The accident was caused by the minor’s drunk or intoxicated driving behavior.
