NC Dram Shop Liability Lawyer
Liability in Drunk Driving Accidents
In some states, businesses that sell alcoholic drinks to obviously intoxicated or underage persons may be held liable for injuries those people cause. This is referred to as the Dram Shop Act. As an example, the victim of a drunk driving accident can pursue compensation from the bar that served the driver alcohol if the driver was obviously intoxicated or underage when served alcohol by the bar. This can provide another source of compensation in a personal injury or wrongful death lawsuit involving an intoxicated person’s negligence or wrongdoing.
CR Legal Team handles Dram Shop Act lawsuits for clients across the nation. As injury attorneys, we have seen many times the devastating consequences of drunk driving crashes many times. We are committed to helping victims of drunk driving accidents by holding at-fault parties accountable for their conduct. If this includes a bar, restaurant, nightclub, or other establishment, we will consider how the dram shop laws may apply.
About Dram Shop Laws
Depending on where you live, dram shop laws may or may not be applicable in a drunk driving case. In North Carolina, for example, the General Statutes §18B-121 allows an injured person to hold an alcohol vendor accountable if:
- The vendor sells or serves alcohol to a minor under the age of 21;
- The minor causes a car accident while under the influence of that alcohol; and
- The accident was caused by the minor’s drunk or intoxicated driving behavior.
In many other states, there are no specific dram shop laws that apply to drunk driving accidents and alcohol vendor liability. Because these laws vary state by state, it is extremely important to discuss your specific circumstances with an attorney as soon as possible.
