Who Qualifies for SSD Benefits?

CR Legal Team Can Stand Up For You.

SSD Eligibility

If you are suffering from a serious medical condition that has rendered
you unable to work for an extended period of time, you may be eligible
for Social Security Disability (SSD) benefits. Determining whether you
qualify can be difficult, and more than half of claims are denied by the
Social Security Administration (SSA) due to eligibility issues.

At CR Legal Team, our Social Security Disability attorneys can offer guidance
regarding whether you may qualify. We can help you file your claim and
can file an appeal if your claim was denied. We take your concerns to
heart and use our resources to seek the benefits you need.

SSD Eligibility Requirements

Every case is different, but there are two primary requirements that must
be met in order to be eligible for Social Security Disability benefits:

  • You must have a certain number of work credits. You must have worked long
enough and recently enough to be covered by Social Security Disability
Insurance (SSDI). Work credits are based on your total yearly wages, and
you can earn up to four credits per year. SSD eligibility based on work
credits will vary depending on your age, ranging from 6 credits for workers
under the age of 24 all the way to 40 credits for workers over the age of 62.

  • You must meet the SSA’s definition of “disability.” The
SSA determines eligibility for SSD benefits based on total disabilities,
which render you unable to work. Your medical condition may qualify as
    a disability if:

    • It prevents you from doing the work you did before;

    • You cannot adjust to or perform any other type of work because of your
      medical condition; and

    • Your condition has lasted or is expected to last for at least one year
      or result in death.

Standing Up for Our Clients & the Community

It is an unfortunate truth that many people will need legal help in seeking
Social Security Disability benefits. The claims process is far from easy,
and a single mistake could result in a denial. As SSD lawyers, we believe
in standing up for our clients and the community as we pursue disability
benefits for those in need.
